Terms and conditions

The aim of these terms and conditions is to set out the agreement between us (Design Training) and the client.

 

Agreement with the client


1) Your Training booking.

You are booking a trainer to provide you with the training course(s) specified, on the dates specified on the booking form.

Bookings are normally made for a full day (usually 5 - 6 hrs of training), unless other arrangements have been agreed in writing. Training times will be confirmed on the booking form or by email. Bookings are charged at a daily rate or course rate for block bookings.

If training is to be held at your office, home (or other training room facilities arranged for the training), you are responsible for ensuring that all necessary equipment and software is available and that it is fully functional in time for the training.

Please ensure you have booked the correct course for your needs, and that we have accurate information on the level of training required.

Please give details of any specific training requirements on the booking form or by email.

No responsibility will be accepted for any trainer being unable to provide the exact training you require if you have not provided correct and full information regarding your training requirements before booking the training.

You should notify us as soon as possible of any problem you may have with a trainer or the training. This should happen as soon as possible on the day the problem occurs, and not at the end of a training course.

 

2) Payment of training fees by client

The prices normally quoted in correspondence and on the booking form are for payment in advance of the training start date. For these early payment rates to apply, payment must be made as stated below.

2a) Training payments must be received at least 21 days in advance of training start date.
For later bookings (made less than a month before the training start date), payment will be due immediately after confirming the booking (or within 7 days of invoice). For very short notice booking payment may be due within 3 days of invoice.

2b) Any discounts given will only apply if the payment is received when due.

2c) Travel expenses and any necessary accommodation expenses for on-site training shall be paid by the client on top of the course fees. You will normally be quoted a total cost including all expenses.

2d) Payment must be made directly to Design Training and we will then pay the trainer.
These terms apply to all bookings unless other arrangements have been agreed in writing at the time of booking and alternative arrangements are stated on the booking form.
Dates will not normally be confirmed for you until the payment is received.

2e) Changes to training requirements.
We reserve the right in all cases to adjust the cost of the training, and invoice for any additional charges which would apply, where the client makes significant changes the training requirements after the training has been booked / confirmed, or when the trainer arrives to do the training. This may include: requiring a different level of training, wanting a customised course, adding additional trainees, etc.


3) Late payment

3a) If payment is made later than stated in section 2a, and the training goes ahead, then a higher rate for the training shall apply:

  • For bookings of up to £1000 in value, the amount due will increase by + £50.
  • For bookings of £1001 and above in value, the amount due will increase by + £100.

Where payment is not made as specified in section 2a, then the payment must be made in full at the higher rate (as specified in 3a) and must be paid in full no later than 14 days after the date when payment was due.

3b) Any discounts given will only apply if the payment is received when it is due — as specified on the booking form and invoice.

3c) Any further costs, such as time spent trying to obtain payment (writing letters, making phone calls, etc.), will also be added to the outstanding amount owed. This will be charged at £60/hr, in 15 minute blocks (minimum charge £15).

3d) Should payment not be received in full within 6 weeks after the payment due date, then legal action may be taken to recover the total amount owed as well as all extra charges and legal costs.

These terms apply to all bookings unless other arrangements have been agreed in writing at the time of booking.

Training fees and the payment due date will be stated on your invoice.

 

4) Cancellation or changes to a training booking

4a) Requests for cancellation or rescheduling of booked dates must be received in writing a minimum of 21 days before the start date of training. Please also confirm by telephone.

If a course or part of a course is rescheduled with 21 days or more notice, there will normally be no extra charges.

If a course is cancelled with 21 days or more notice, you will be entitled to a full refund of the fees paid for each day cancelled, minus a 10% administration fee.

If less than 21 days notice is given then the cancellation charges below will apply.

4b) Cancellation Charges

Cancellation charges will apply to all training bookings cancelled or rescheduled 20 days or less before training start date.
Where part of a course is cancelled or rescheduled, these charges will apply to each day cancelled or rescheduled.

15 - 20 days before the start of training:
The client will pay 25% of the total value of training,
The remainder can be credited towards another booking or refunded.

8 - 14 days before the start of training:
The client will pay 50% of the total value of the training.
The remainder can be credited towards another booking or refunded.

7 days or less before the start of training:
The client will pay 100% of the total value of the training.

Cancellation on the day of training:
The client will pay 100% of the total value of the training.

4c) When cancelling a booking for on-site training the client will pay for any expenses incurred, such as for train tickets or accommodation already purchased. Any other expenses which were included in the training fees will normally be subtracted from the amount due for cancelled or rescheduled days, and added to your credit or refund value.

4d) Where part of a course is cancelled, and discounts were applied to the original booking (e.g. multi-day booking discounts), then the day rate for the cancelled days, and for the remaining booked days may be different, as some discounts may no longer apply.

4e) Where a trainer visiting your office or home is unable to provide you with training because the necessary resources (for example, training space, software or computer equipment) are not available or are not fully functional, this will be treated as a cancellation and full payment for that day will be due.

 

5) Cancellation or rescheduling of training by us

5a) We will try not to do this unless we absolutely have to, however we reserve the right, in every case, to reschedule or to cancel all or part of a course if necessary. You will usually be given a minimum of 14 days notice with the exception of certain unforeseen or exceptional circumstances (see below ). If it does become necessary to reschedule or cancel, you will be entitled to take that course at a later date or receive a refund of fees paid for each day of training cancelled.

5b) Cancellation or rescheduling due to unforeseen or exceptional circumstances
We reserve the right, in every case, to cancel or reschedule all or part of a course at short notice due to unforeseen or exceptional circumstances. This may include power failure, train cancellation or strike, exceptional weather conditions, illness or injury.
You will have the option to reschedule the course at a later date, or to have a refund of fees paid for each day of training cancelled.

5c) Responsibility will not accepted for any consequential loss arising from cancellation or curtailment of any course by us.

 

6) Trainers

6a) The training will be contracted to one of the freelance trainers who works with us. All our trainers are very professional and have many years of training experience. Most trainers also have experience of working in the design industry and many trainers do both training and design work.
The trainer may follow a course outline available from us or they may follow their own course structure or provide a custom course based on details which the client has provided. The course required will be discussed with the trainer and client in advance of the training.

6b) Responsibility will not accepted for any loss or damage arising from the actions of any trainer, and any claim should be made directly with the trainer.

Agreement with trainer

This applies where training is contracted to a freelance trainer.

Before the training is arranged, the trainer will confirm their total price for the job (this must include any agreed travel expenses and accommodation expenses, as well as any extra charges for notes, manuals or books, and any VAT - if they are VAT registered).

The trainer will be responsible for paying all travel and accommodation expenses related to the the training, and where appropriate these expenses should be included in your invoice to us. Only those expenses previously agreed will be paid, extra fees, costs and expenses which were not stated by the trainer in their price for the job will not be paid.

The trainer should at all times behave in a responsible and professional manor when dealing with the client and working on the clients premises.
The trainer is responsible for ensuring that they are correctly insured against any liability claims for damage caused by them while working at the clients premises.

Payments to the trainer
Payment will be made to the trainer after the training has taken place, and after an invoice is received from the trainer for the agreed amount. Payment will normally be made quickly after the training, this is nearly always within 14 days after training completion but may sometimes be slightly later if the payment is received late from the client.
